The court president, Mrs Ronke Adetola, held that the marriage had broken irretrievably as the DNA carried out on the children confirmed that the petitioner is not their biological father.
Adetola ordered the respondent to take the three children to their father and vacate the premises where they lived as husband and wife.
Muraina, 40, a businessman, who resides at 11, Muraina Close, Agbede, Ikorodu, Lagos State, had on March 31, submitted to the court the DNA result showing that he was not the father of the children.
He told the court that the DNA test had confirmed that the children did not belong to him.
The petitioner said that he went for the test after repeated comments by his wife that he was not the father of the children.
Muraina further told the court that Mariam gave birth to all the three children while living with him.
“She was always saying jokingly that I am not the father of the three children anytime we had a misunderstanding.
“Please separate us, I don’t want to waste my money on another man’s children and I don’t want to live with them again,’’ he said.
Mariam, 30, did not deny the allegation and consented to the dissolution of the union.
“Since the DNA test confirmed that he is not the father of my children, separate us, so that I can continue with my life.
“He had earlier burgled my wardrobe and took away my money.
“Please help me to tell him to return the money so that I can use it to take care of my children,” she said.
